Informal Update on the EEO Special File

Joseph Donovan, the Director of Research and Analytic Services at the Equal Employment Opportunity Commission (EEOC), has provided an informal update to the status of the EEO Special File.  The EEO Special File is commonly used by the OFCCP to determine the reasonableness of availability estimates (see http://www.dol.gov/ofccp/regs/compliance/censuseo.htm).  The update states that the 2010 file “will be very similar to the 2000 EEO File.  A major difference is that the next Special File and subsequent ones will be created from a five-year roll-up of American Community Survey (ACS) data, e.g., ACS data from 2006 through 2010.”  In addition, the 2010 File will use  the 2010 Standard Occupational Classification System (see http://www.bls.gov/soc/classification2010.htm) which encompasses approximately 470 occupational categories.  Two changes from the 2000 File to the 2010 File is the addition of a citizenship variable with two categories; also for every number and estimate, the standard error or margin of error will be made available.  The Census anticipates that a data tool will be made available to access the data and to create cross-tabulations and tables by users.  The release date for the 2010 EEO Special File is currently planned for Fall 2012.

Functional Affirmative Action Plans (FAAPs) are Discontinued

The OFCCP has announced that it will no longer develop new or renew Functional Affirmative Action Plans (FAAPs). The announcement states, “The agency is currently reviewing its policies regarding the FAAP process. We will issue new guidance in the near future. Until such guidance is issued, contractors without FAAP agreements should continue to develop and maintain establishment-based AAPs. Contractors with approved FAAP agreements should maintain their functional unit AAPs and operate under their current FAAP agreement. If significant changes occur in the normal order of business for contractors with existing FAAP agreements, such as mergers, acquisitions, divestitures, and recent changes, these should be reported to the FAAP Director for appropriate actions, as per the agreement. OFCCP will notify contractors when new guidance is published.” The notice is available at http://www.dol.gov/ofccp/FAAP_Notice.htm.

Employee Notification Requirements for Federal Contractors and Subcontractors

On May 20, 2010, the Department of Labor issued a Final Rule requiring Federal government contractors and their subcontractors to post a notice informing employees of their rights under the National Labor Relations Act (NLRA) and to include the provisions of the notice in government contracts, subcontracts and purchase orders. (See http://edocket.access.gpo.gov/2010/pdf/2010-11639.pdf) The required notice/poster is to be in place as of June 21, 2010. Contractors and subcontractors who post notices to employees electronically must also post it electronically According to the OFCCP, “The notice to employees required by the regulations inform employees about their rights under the NLRA to form, join and assist a union and to bargain collectively with their employer; provides examples of unlawful employer and union conduct that interferes with those rights; and indicates how employees can contact the National Labor Relations Board, the Federal agency that enforces those rights, with questions or to file complaints. Contractors that violate the Labor Department's regulations requiring employee notification of these rights may be subject to sanctions, including suspension or cancellation of the contract.” Contractors and subcontractors may also be declared ineligible for future contracts. These posting requirements do not apply to prime contracts under $100,000 and subcontracts below $10,000.

New EEOC Chair Jacqueline A. Berrien Urges Support of “Protecting Older Workers Against Discrimination Act

On May 6th, newly appointed EEOC Chair, Jacqueline A. Berrien appeared before the Senate Committee on Health, Education, Labor and Pensions to urge support of S. 1756 (H.R.3721), known as the “Protecting Older Workers Against Discrimination Act.” The Commission “believes that legislation is needed to restore and bolster the basic protections that applied to the Age Discrimination in Employment Act (ADEA) claims pre-Gross.” Under the Supreme Court’s decision in Gross v. FBL Fin. Servs. Inc., the plaintiff is required to show that age was “the only or the 'but-for' reason" for the alleged adverse employment action and could not also claim there was another unlawful motive involved (such as race). The legislation, as it stands, would also apply to other federal employment discrimination laws, to prohibitions against retaliation, and allow the same remedies under the ADEA, as Title VII plaintiffs may recover.

Berrien stated that “The Gross ruling could not have come at a worse time. More than 40 years after Congress passed the ADEA, age discrimination may be at historic highs.” She cited a jump of 30% in EEOC age discrimination charges from FY2007 to FY2008, and a high number of charges in FY2009, as well (constituting over 24% of all charge receipts). EEOC Celebrates its 45th Anniversary

This July 2nd marked the 45th anniversary of the EEOC, created to enforce Title VII of the Civil Rights Act of 1964.  The EEOC is planning events at its Washington, DC headquarters and across the country. The EEOC website at http://www.eeoc.gov will also be updated with anniversary materials.
